You acknowledge and agree that Favor has the right to resubmit any Charge authorized by you that is refused for any reason or returned for insufficient or uncollected funds. If your primary payment method is unavailable for any reason, in particular because the card is not valid or declined, Favor reserves the right to automatically charge other payment methods you have on file.

tipping. After the runner pays for the order, the Favor Service will automatically suggest a tip to the runner based on various factors, including but not limited to the type of order, the merchant, the total amount of the order, and/or the distance traveled by the runner. You can customize the amount of the tip; However, a minimum tip applies to all orders. You understand and agree that while you are free to make an additional payment in excess of the Minimum Tip as an additional tip to any Runner offering you services or goods, you are not obligated to do so. You acknowledge and agree that gratuities above the Minimum Amount are optional.

Steer. Customer acknowledges and agrees that, as between Favor and Customer, Customer is responsible for the cost of any sales or similar taxes related to orders placed by Customer through the Favor Service.

referral program. Active Favor customers may receive credit toward future Favor purchases if a referred friend who has not previously registered as a Favor user creates a valid Favor account (and agrees to abide by these Terms) and uses your personal invitation makes a first purchase from Favor and completes code.

Personal invite codes may only be used for personal and non-commercial purposes. This means that you can share your invitation link with your personal contacts via social media where you are the main owner of the content. Public distribution on sites to which you contribute but are not the primary owner of the content is not permitted. Advertising your referral code via search engine marketing is also not permitted. Favor reserves the right to refuse referral codes that are publicly posted in violation of these Terms and to request that such referral codes be removed. If you post or share your referral code in connection with your opinion or experience regarding Favor or the Favor Service, you may be required to notify your audience that you will receive credit for using your code, as required by federal guidelines trade commission.

Favor may, in its sole discretion, limit the total Referral Credits a User may receive in the same calendar year and may change such limit from time to time in its sole discretion. The referral program is void where prohibited.

credits. Favor Credits have no cash value, are redeemable only for Favor orders, and may, at our sole discretion, be subject to expiration dates or other restrictions as specified at the time of crediting. Gift vouchers are for promotional purposes only and cannot be redeemed for cash or cash equivalents including but not limited to gift cards or refunds under any circumstances. Favor credit and gift cards cannot be used on age-restricted items. Favor Credits are non-transferrable and may not be auctioned, traded, bartered, or sold. If you have any questions about credits, please contact us via this link.

No refund. Fees paid by you for completed and delivered orders are final and non-refundable. Favor is not obligated to provide refunds or credits, but in any event may grant them at Favor’s sole discretion.

12. Interactions with Other Users: We are not responsible for your interactions with other users.

The Favor Service was developed to facilitate transactions between runners, merchants and customers. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS AND TRANSACTIONS WITH RUNNERS AND DEALERS, AGREE TO EXCLUSIVELY CONTACT AND EXPRESSLY CONTACT SUCH RUNNERS AND DEALERS FOR ANY CLAIM, DAMAGES OR LIABILITY RELATED TO TRANSACTIONS PLACED THROUGH THE FAVOR SERVICE OR AN ORDER FAVOR TO WAIVE AND RELEASE ANY AND ALL CLAIM, DAMAGES AND LIABILITY ARISING OUT OF ACTS OR OMISSIONS OF ANY RUNNER OR DEALER, INCLUDING, WITHOUT LIMITATION, DAMAGES RELATED TO PERSONAL INJURY OR DESTRUCTION OF PROPERTY. Favor has no obligation to monitor or resolve disputes between customers, runners and merchants.

13. Communication: Favor and Runners will communicate with you. You will be asked to rate favor and runner.

Favor and certain third parties (e.g. Runners) need to communicate with you through the Favor Service, including any delivery requests you make through the Favor Service. In addition, we would like to make certain commercial offers available to you from time to time. THEREFORE, YOU AGREE TO RECEIVING MESSAGES (WHETHER BY PHONE, EMAIL, SMS OR PUSH NOTIFICATIONS) FROM FAVOR, RUNNERS AND/OR OUR THIRD PARTY PARTNERS AND CONFIRM AND AGREE THAT YOUR PHONE NUMBER, EMAIL ADDRESS AND OTHER INFORMATIONEN ANGEGEBEN WERDEN DÜRFEN ZUM ZWECK DER INITIALISIERUNG VON KOMMERZIELLEN NACHRICHTEN VERWENDET WERDEN.

Wir werden Ihnen erlauben, den Erhalt einiger dieser Nachrichten abzulehnen, aber um den Erhalt jeglicher Nachrichten von uns zu stoppen (einschließlich administrativer Nachrichten bezüglich des Favor-Dienstes oder Nachrichten, die sich hauptsächlich auf Transaktionen beziehen, die über den Favor-Dienst aktiviert werden), müssen Sie um Ihr Konto zu kündigen. Favor übernimmt keine Gewährleistung oder Billigung und übernimmt Ihnen oder anderen Personen gegenüber keine Haftung oder Verantwortung für Dienstleistungen Dritter, Materialien Dritter oder Websites.

FAVOR ÜBERNIMMT KEINERLEI VERANTWORTUNG FÜR INHALTE, TECHNOLOGIEN, DIE VON DRITTEN IMPLEMENTIERT WERDEN, ODER DIE DATENSCHUTZPRAKTIKEN VON DRITTEN. IHRE NUTZUNG VON MATERIALIEN VON DRITTANBIETERN ERFOLGT AUF IHR EIGENES RISIKO UND UNTERLIEGT ALLEN ANWENDBAREN BEDINGUNGEN UND RICHTLINIEN DRITTER (Z. B. BEDINGUNGEN UND DATENSCHUTZRICHTLINIEN).

15. Einschränkungen der Verfügbarkeit: Der Favor Service ist möglicherweise nicht immer und überall verfügbar.

Der Favor Service ist nicht jederzeit, in allen Sprachen oder in allen Regionen verfügbar. Wir sind derzeit nur in ausgewählten Städten verfügbar. Favor gibt keine Zusicherung ab, dass der Favor-Dienst eine bestimmte Betriebszeit erreichen wird oder dass der Favor-Dienst für die Nutzung an einem bestimmten Ort geeignet oder verfügbar ist. Favor kann auch die Nutzung oder den Zugriff auf den Favor-Dienst gemäß den gesetzlichen Bestimmungen einschränken. Die Nutzung des Favor Service ist dort ungültig, wo es verboten ist.

16. Laufzeit und Kündigung: Jeder von uns kann diese Vereinbarung jederzeit kündigen.

Diese Vereinbarung tritt mit unserer Annahme in Kraft, nachdem Sie Ihre Zustimmung gegeben und alle erforderlichen Informationen zur Eröffnung Ihres Kontos bereitgestellt haben, und wird fortgesetzt, bis sie entweder von Ihnen oder uns gekündigt wird (dieser Zeitraum wird als „Laufzeit“ bezeichnet). Ihr Recht zur Nutzung oder zum Zugriff auf den Favor-Service erlischt automatisch ohne Benachrichtigung von uns, wenn Sie Bedingungen dieser Vereinbarung nicht einhalten, einschließlich, aber nicht beschränkt auf die Kunden-Community-Richtlinien, die Runner-Community-Richtlinien oder andere hierin genannte Bedingungen. Bei Beendigung des Vertrags erlöschen alle Ihnen im Rahmen dieses Vertrags gewährten Rechte. Die Abschnitte 7, 8, 9, 12, 13, 18, 20, 22, 23 und 24 bleiben auch nach Beendigung oder Ablauf bestehen. Alle anderen Rechte und Pflichten sind unwirksam.

17. Bedingungen für den Marktplatz für mobile Apps: Sie geben bestimmte Zusicherungen zu Anbietern von App-Marktplätzen ab.

Danksagungen zu Marktplatzanbietern. Sie verstehen, dass diese Vereinbarung zwischen Ihnen und Favor besteht und nicht mit Apple Inc. („Apple“), Google, LLC („Google“) oder einem anderen Anbieter eines Marktplatzes für mobile Anwendungen, und dass Favor (nicht der Anbieter des Marktplatzes) dafür verantwortlich ist die App. SIE ERKENNEN AN UND STIMMEN ZU, DASS KEINE ANDERE PERSON ODER JURISTISCHE PERSON IRGENDWELCHE GEWÄHRLEISTUNGEN GEMÄSS DIESER VEREINBARUNG ÜBERNIMMT ODER IRGENDWELCHE GEWÄHRLEISTUNGSVERPFLICHTUNGEN IN BEZUG AUF DIE APP HAT. You acknowledge that marketplace providers have no obligation whatsoever to furnish any maintenance and support services with respect to the App or for addressing any claims relating thereto or your possession and/or use thereof, including, but not limited to (a) product liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection or similar legislation. You further acknowledge that such providers have no responsibility for the investigation, defense, settlement, or discharge of any third-party intellectual property claims the App, the Favor Service, or your use thereof infringes intellectual property rights.

18. Disclaimers and limitations of liability: We disclaim all warranties. Our liability to you is limited.

This section is important—please read it carefully. It limits Favor’s liability (and the liability of its affiliates) to you. These disclaimers and limitations apply only to the extent permitted by applicable law. Some jurisdictions do not allow disclaimers of implied warranties or limitations of liability, so this section may not apply to you.

Disclaimer of warranties. EXCEPT AS EXPRESSLY STATED ABOVE, THE FAVOR SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT MAKE ANY WARRANTIES REGARDING ANY RUNNER AND THEIR DELIVERY SERVICES OR MERCHANTS AND THEIR PRODUCTS.

Limitation of liability. NEITHER WE NOR OUR AFFILIATES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE FAVOR SERVICE, OR THE FULFILLMENT OF ORDERS, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NEITHER WE NOR OUR AFFILIATES WILL HAVE LIABILITY HEREUNDER OR TO YOU OR TO ANY THIRD PARTY IN CONNECTION WITH THE APP, THE WEBSITE, THE FAVOR SERVICE, OR RELATED MATTERS FOR AGGREGATE DAMAGES IN EXCESS OF THE GREATER OF: (a) U.S. $50.00, OR (b) THE TOTAL DOLLAR VALUE OF TRANSACTIONS YOU PLACED VIA THE FAVOR SERVICE, IF ANY, IN THE 12 MONTHS PRIOR TO THE CLAIM. THE ABOVE LIMITATIONS APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

19. Export and other restrictions: You agree not to violate export laws. Additional terms apply to government users.

You may not use or otherwise export or re-export the Favor Service or elements of it, except as authorized by United States law and the laws of the jurisdiction in which the Favor Service was accessed or obtained. You also agree that you will not use the Favor Service for any purposes prohibited by applicable law. The Favor Service and related documentation are “Commercial Items” as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation” as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to US government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

20. Modifications: The Agreement may be changed.

Favor reserves the right, at any time, to change these Terms by notifying you of such changes by any reasonable means, including without limitation by posting a revised version of these Terms through the Favor Service. Any such changes will not apply to any dispute between you and us arising prior to the date on which we posted the revised Terms incorporating such changes, or otherwise notified you of such changes. By using the Favor Service following any such changes, you agree to be bound by such revised Terms. You may reject such changes by ceasing all use of the Favor Service. You should periodically visit this page to review the most current Terms; the “Last Updated” legend indicates when these Terms were last updated. In addition, we may at any time and without liability modify or discontinue all or part of the Favor Service (including access to the Favor Service via third-party links); charge, modify, or waive any fees required to use the Favor Service; or offer opportunities to some or all Favor Service users.

21. Force majeure: Neither of us will be in breach of this Agreement due to forces beyond our control.

Neither party will be in default for failing to perform any obligation, other than payment of monies, if the failure is caused solely by conditions beyond the parties’ respective control, including acts of God, civil commotion, strikes, terrorism, failure of third-party networking equipment, illegal acts of third parties, failure of the public internet or changes in the accessibility of third-party websites, power outages, labor disputes, or governmental demands or restrictions.

22. Indemnity: You will hold us harmless from your misuse of the Favor Service.

You shall defend, indemnify, and hold Favor and its affiliates and each of their directors, officers, employees, agents, assigns, and representatives harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees and litigation expenses) relating to or arising from (a) your access to or use of the Favor Service or any materials (including Third-Party Materials), products, or services available through the Favor Service, (b) any of your Feedback, or (c) any violation or alleged violation by you of any provision of these Terms.

23. Disputes: YOU HEREBY AGREE TO MANDATORY BINDING ARBITRATION.

PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH FAVOR AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.

Binding arbitration. EXCEPT FOR ANY DISPUTES, CLAIMS, SUITS, ACTIONS, CAUSES OF ACTION, DEMANDS, OR PROCEEDINGS (COLLECTIVELY, “DISPUTES”) IN WHICH EITHER PARTY SEEKS TO BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT OR SEEKS INJUNCTIVE OR OTHER EQUITABLE RELIEF FOR THE ALLEGED UNLAWFUL USE OF INTELLECTUAL PROPERTY INCLUDING WITHOUT LIMITATION, COPYRIGHTS, TRADEMARKS, TRADE NAMES, LOGOS, TRADE SECRETS, OR PATENTS, YOU AND FAVOR AGREE (a) TO WAIVE YOUR AND FAVOR’S RESPECTIVE RIGHTS TO HAVE ANY AND ALL DISPUTES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES RESOLVED IN A COURT, AND (b) TO WAIVE YOUR AND FAVOR’S RESPECTIVE RIGHTS TO A JURY TRIAL. INSTEAD, YOU AND FAVOR AGREE TO ARBITRATE DISPUTES THROUGH BINDING ARBITRATION (WHICH IS THE REFERRAL OF A DISPUTE TO ONE OR MORE PERSONS CHARGED WITH REVIEWING THE DISPUTE AND MAKING A FINAL AND BINDING DETERMINATION TO RESOLVE IT INSTEAD OF HAVING THE DISPUTE DECIDED BY A JUDGE OR JURY IN COURT). You and Favor agree that for any arbitration you initiate, you will pay the filing fee (which shall not exceed $250, and if such fee does exceed $250 Favor shall pay the difference) and Favor will pay the remaining Judicial Arbitration and Mediation Services (“JAMS”) fees and costs. If you cannot afford to pay for the arbitration you agree to provide us the option of paying the arbitrator before seeking to initiate any other form of dispute resolution, including litigation. For any arbitration initiated by Favor, Favor will pay all JAMS fees and costs.

No class arbitrations, class actions or representative actions. YOU AND FAVOR AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES IS PERSONAL TO YOU AND FAVOR AND THAT SUCH DISPUTE WILL BE RESOLVED SOLELY THROUGH INDIVIDUAL ARBITRATION AND WILL NOT BE BROUGHT AS A CLASS ARBITRATION, CLASS ACTION, OR ANY OTHER TYPE OF REPRESENTATIVE PROCEEDING. YOU AND FAVOR AGREE THAT THERE WILL BE NO CLASS ARBITRATION OR ARBITRATION IN WHICH AN INDIVIDUAL ATTEMPTS TO RESOLVE A DISPUTE AS A REPRESENTATIVE OF ANOTHER INDIVIDUAL OR GROUP OF INDIVIDUALS. FURTHER, YOU AND FAVOR AGREE THAT A DISPUTE CANNOT BE BROUGHT AS A CLASS OR OTHER TYPE OF REPRESENTATIVE ACTION, WHETHER WITHIN OR OUTSIDE OF ARBITRATION, OR ON BEHALF OF ANY OTHER INDIVIDUAL OR GROUP OF INDIVIDUALS.

Federal Arbitration Act. You and Favor agree that these Terms affect interstate commerce and that the enforceability of this Section 234 shall be both substantively and procedurally governed by and construed and enforced in accordance with the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (the “FAA”), to the maximum extent permitted by applicable law.

Notice of informal Dispute resolution. You and Favor agree that each party will notify the other party in writing of any arbitrable or small claims Dispute within thirty (30) days of the date it arises, so that the parties can attempt in good faith to resolve the Dispute informally. Notice to Favor shall be sent by certified mail or courier to 2416 E. 6th Street, Austin, Texas 78702, Attn: Legal Department. Your notice must include (a) your name, postal address, telephone number, the email address you use or used for your Favor account and, if different, an email address at which you can be contacted, (b) a description in reasonable detail of the nature or basis of the Dispute, and (c) the specific relief that you are seeking. Our notice to you will be sent electronically and will include (i) our name, postal address, telephone number, and an email address at which we can be contacted with respect to the Dispute, (ii) a description in reasonable detail of the nature or basis of the Dispute, and (iii) the specific relief that we are seeking. If you and Favor cannot agree how to resolve the Dispute within thirty (30) days after the date notice is received by the applicable party, then either you or Favor may, as appropriate and in accordance with this Section 234, commence an arbitration proceeding or, to the extent specifically provided for in this Section 234, file a claim in court.

Verfahren. EXCEPT FOR DISPUTES IN WHICH EITHER PARTY SEEKS TO BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT OR SEEKS INJUNCTIVE OR OTHER EQUITABLE RELIEF FOR THE ALLEGED UNLAWFUL USE OF INTELLECTUAL PROPERTY INCLUDING WITHOUT LIMITATION COPYRIGHTS, TRADEMARKS, TRADE NAMES, LOGOS, TRADE SECRETS, OR PATENTS, YOU AND FAVOR AGREE THAT ANY DISPUTE MUST BE COMMENCED OR FILED BY YOU OR FAVOR WITHIN ONE (1) YEAR OF THE DATE THE DISPUTE AROSE, OTHERWISE THE UNDERLYING CLAIM IS PERMANENTLY BARRED (WHICH MEANS THAT YOU AND FAVOR WILL NO LONGER HAVE THE RIGHT TO ASSERT SUCH CLAIM REGARDING THE DISPUTE). You and Favor agree that (a) any arbitration will either occur (i) in person in Travis County, Texas or, if requested in your Dispute notice, in the US county where your permanent residence is located, (ii) by written submissions, or (iii) telephonically, (b) arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of the JAMS, which are hereby incorporated by reference, and (c) that the state or federal courts of the State of Texas and the US, respectively, sitting in the State of Texas, in Bexar County, have exclusive jurisdiction over any appeals and the enforcement of an arbitration award. You may also litigate a Dispute in the small claims court located in the county of your billing address if the Dispute meets the requirements to be heard in small claims court.

Authority of arbitrator. As limited by the FAA, these Terms and the applicable JAMS rules, the arbitrator will have (a) the exclusive authority and jurisdiction to make all procedural and substantive decisions regarding a Dispute, including the determination of whether a Dispute is arbitrable, and (b) the authority to grant any remedy that would otherwise be available in court; provided, however, that the arbitrator does not have the authority to conduct a class arbitration or a representative action, which is prohibited by these Terms. The arbitrator may only conduct an individual arbitration and may not consolidate more than one individual’s claims, preside over any type of class or representative proceeding, or preside over any proceeding involving more than one individual.

Rules of JAMS. The rules of JAMS and additional information about JAMS are available on the JAMS website. You agree that the exclusive venue for resolving any Dispute between Favor and you including but not limited to any Dispute arising out of or related to this Agreement, shall be the state and federal courts located in Travis County, Texas, and you consent to the jurisdiction of the federal and state courts located in Travis County, Texas. You further acknowledge and agree that many of the witnesses and records that would be relevant to any dispute between the parties are located in Austin, Texas, and that Austin, Texas would not be an inconvenient forum for the resolution of any dispute between the parties. You hereby waive any objection to Austin, Texas as a forum and venue for the hearing of any dispute between Favor and you.

25. Assignment: We may assign this Agreement. You cannot assign it unless you get our permission.

We may freely transfer or assign this Agreement and any of our rights or obligations. You may not transfer or assign this Agreement or any of your rights or obligations without our prior written consent, and any attempt to do so will be null and void.

26. Exclusion of California and European Economic Area Customers: You cannot use the Favor Service if you are from or otherwise reside in California or the EEA.

You agree to access and use Favor Service only within the jurisdictions in which Favor operates. If you are a resident of California or the European Economic Area (“EEA”), you may not access or otherwise use the Favor Service or provide Favor with any personal information or cause Favor to receive any personal information of any California or EEA resident.

27. Miscellaneous: This is how to interpret this Agreement.

This Agreement, and the documents we reference in this Agreement, is the entire Agreement between Favor and you regarding the Favor Service. Our failure to exercise or enforce any right will not operate as a waiver of such right. Headings and the summaries before each section of this Agreement are provided for convenience and to aid in readability only. These headings and summaries have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. Your website probably exists on your web host’s server with hundreds if not thousands of other websites. Resources such as processing power, memory and disk space are shared by all websites that exist on this server. To ensure that all websites hosted on a shared hosting plan get a fair amount of server resources, web hosts set a cap on those resources for each account.

Typically, a web host will notify you when you reach or exceed the resource limit before your account is banned. So if you’ve been getting emails about reaching resource limits, it’s a good time to start analyzing your hosting usage. Some of the questions to ask yourself are:

There is most likely a buggy plugin or theme that is using excessive resources. Unfortunately, this is extremely difficult to debug because while some hosts like Cloudways will show you resource usage, most web hosts don’t have such granular data.

You can try disabling plugins and themes one by one to see which one is causing the overconsumption, but it’s an ineffective and time-consuming process. You may need to bring in an experienced developer at this point.

A quick fix if you have backups is to migrate to another hosting provider with better resource plans. This will get your website up and running quickly and you can debug with peace of mind.

It might be tempting to upgrade and fix the problem, but it can be a superficial fix. Often there is an underlying issue and moving to a higher plan will not fix those issues. To prevent bot traffic, you need a firewall for your website.

One of the emails we received was from a former pharmacy website and the web host was rejecting the products for sale as they are heavily regulated. The website was blocked, the account was then deleted and the admin was refunded his money.

We want the Favor App, Website and Service (collectively, the “Favor App” or “App”) to be a fun and flexible way for customers, runners and merchants to connect, make money and have it all delivered to get.

Customer access to the Favor App

Just as we have guidelines for runners, we also have guidelines for customers. These policies describe situations where a user’s access to the Favor App could be restricted, suspended, or even disabled. These situations include, but are not limited to, fraud, security threats, discrimination, and the quality of other users’ experiences.

We want the Favor app to be a safe experience for everyone involved: customers, runners and retailers. Accordingly, Favor reserves the right to terminate the access of any customer who compromises the safety of a runner, dealer or other customer or otherwise creates a threatening or unsafe situation. Such situations include, but are not limited to, the following:

Inappropriate or abusive language. Ask overly personal questions, use harsh or offensive language, or make comments or gestures that are sexual, aggressive, discriminatory, or offensive.

Uninvited contact with a runner. Texting or calling a Runner without an invitation (outside of an accepted favor), contacting a Runner on social media without an invitation, hugging a Runner, or other unwanted physical contact.

Harassment and damage to a runner. No one should be subject to physical, verbal, or sexual abuse, harassment, domestic violence, robbery, or other acts of violence.

Using Favor in Violation of the Law. Encouraging a Runner to break local or state law, supply illegal product, or use the Favor App to commit a crime.

Dangerous or Unsafe Conditions . No runner should be subjected to conditions that would place them in imminent danger to life or limb, or an unsafe situation which could result in injury to the runner or others, or otherwise cause the runner to fear for their personal safety. This may include dark paths, restricted/difficult access, or other barriers.

Aggressive or dangerous animals. No runner should be exposed to an aggressive or dangerous animal. All animals should be restrained during delivery.

Can unsafe or threatening behavior affect access to the Favor App?

Yes. If we believe a customer may be threatening the safety of a runner, customer or retailer, or has otherwise created an unsafe or threatening environment, we may contact the customer to investigate the situation and restrict the customer’s access to the Favor- App in both cases block a runner and a customer until the result of this investigation is available. We may also temporarily disable your account while we investigate the situation. If we ultimately determine that a customer has threatened the safety of a runner, customer, or retailer, we will permanently disable the customer’s access to the Favor App as a runner and as a customer. In all these cases, the customer will be informed of the situation and given the opportunity to respond and appeal. If there is an uncertain situation that would affect the completion of the Favor, Favor reserves the right to cancel the order and charge the customer the full amount that would have been due had the delivery been successful (including any applicable fees and of the recommended tip).

If we determine that the Customer is discriminating against a Runner, Customer, or Vendor based on race, color, religion, national origin, disability, sexual orientation, gender, gender identity, age, or any other characteristic protected under the applicable State or Federal State , or local law, we will permanently block the customer’s access. In all these cases, the customer will be informed of the situation and given the opportunity to respond and appeal.

Fraud

You may not use the Favor App to abuse promotions or refunds, dispute charges for fraudulent or unlawful reasons, provide fraudulent or inaccurate information, or otherwise gain unjustified personal gain.

Can fraud affect access to the Favor App?

Yes. If we have reason to believe that a customer has engaged in fraudulent activity of any kind, we may contact the customer to investigate the situation and suspend the customer’s access to the Favor App pending such investigation. If we determine that the customer is engaged in fraudulent activity, we may suspend or permanently suspend the customer’s access as both a runner and a customer. In all these cases, the customer can be informed of the situation and given the opportunity to respond and object. Restricted Products
