Dental practices in high-traffic areas with good management, a diverse patient population, talented healthcare professionals, and robust marketing and promotional efforts can generate significant revenue even as insurer reimbursement rates fall. According to the American Dental Association, the average gross bills per dentist for owner dentists in 2017 were $718,790 for a general practitioner and $1,058,630 for a specialist. Numbers like this show why a non-dentist would want to open a practice that consists of several dentists and dental hygienists. However, non-dentists need to be very careful when it comes to structuring their relationships with dentists.
Under Florida law, no person other than a Florida licensed dentist or entity other than a professional or limited liability company composed of dentists may:
Employ a dentist or dental hygienist in the operation of a dental practice. Control the use of dental equipment or materials while such equipment or materials are used to provide dental services, whether those services are provided by a dentist, dental hygienist, or dental assistant. To direct, control or interfere with a dentist’s clinical judgment.
By law, a non-dentist may not directly employ a dentist (i.e., W-2 staff), but may work with the dentist as a 1099 independent contractor. The non-dentist cannot pay a dentist a salary or commission. The dentist can form their own wholly owned professional corporation, while the non-dentist can provide their services through an LLC or other taxable entity. There must not be an employment contract between the dentist and the operator, but a self-employment contract may be required. Any dentist employed by a non-dentist may face disciplinary action.
The non-dentist providing the office space and equipment cannot control the use of dental equipment while such equipment or materials are used in the performance of dental services (emphasis added). This means that while the dentist is operating dental equipment, the non-dentist cannot barge in and impose restrictions on how the equipment or materials are used once a patient is being treated. For example, if a dentist is treating a patient and that treatment was expected to take 30 minutes, but is now at the 45 minute mark, the non-dentist cannot physically manipulate dental equipment or tell the dentist to be ready within the next need 5 minutes because another dentist needs to use it. However, a leasing contract may restrict the operation and use of the equipment rented to the dentist in general.
Most importantly, a non-dentist cannot influence a dentist’s clinical judgment by directing them about a course of treatment for a patient. All clinical decisions must be left to the discretion of the dentist. The relationship between the non-dentist and the dentist will be a network of lease, rental, marketing, practice management and administrative agreements. Any dental equipment lease agreement between a non-dentist and a dentist must include a provision stating that the dentist expressly retains complete care, custody and control of the equipment or practice. In addition, an agreement is void if the non-dentist exercises control over:
The selection of a course of treatment for a patient, the procedures or materials to be used in such course of treatment and the manner in which such course of treatment is administered by the dentist; A dentist’s medical record; Policies and decisions regarding pricing, credit, refunds, guarantees and advertising; and decisions regarding office staff and office hours.
A non-dentist may contract with the professional association of dentists to provide administrative services, which may include maintenance of patients’ medical records, but control and ownership of those records does not belong to the management company. The dentist must have unrestricted access to these medical records if necessary.
While a non-dentist cannot dictate the dentist’s practice hours, the rental agreement for the practice premises can include the practice’s opening hours. For example, a rental agreement can grant the dentist access to the doctor’s office between 8:00 a.m. and 8:00 p.m. but the dentist would set his office hours between 9am and 3pm. In addition, only the dentist has control over the hiring and firing of office-approved staff such as dental hygienists, hygienists, technicians, and assistants.
A dentist may enter into an agreement with a non-dentist to receive “practice management services.” The term “practice management services” is defined to include consultation or other activities or services provided by someone other than a Florida licensed dentist regarding one or more of the following types of products or services:

How long does the course last?

Where does the training take place?

Do I have to be in Los Angeles for the course?
no The course is also offered online via Live Cam worldwide. Once you have registered for the course we will contact you to confirm how you would like to complete your training, either online or in person.
If I decide to come to Los Angeles, will there be any expenses paid?
no All registrants wishing to come to Los Angeles to complete the training in person are responsible for their own travel expenses.
Do you offer “in person” classes outside of the state of California? (e.g. travel course)
If you have a group of five or more and the balance is paid in full, we will arrange a trip to your state to conduct an “in person” master class in your area. International travel courses require a group of ten or more people for a master class.
How do I receive my Pro Kit if I decide to take the online course?
We will contact you to confirm your mailing address and send you your Pro Kit well in advance of your scheduled training date. We offer free expedited shipping of Pro Kits within the US. International shipping rates apply to Pro Kits shipped outside of the United States. The trainee is responsible for all duties, taxes and all other regional fees in addition to our international shipping charges.
Do you offer a course without a Pro Kit?
Yes! You can take the Tooth Gem Training Course without getting a full Pro Kit. It comes with a class training kit only which includes 1 LED curing lamp with charger and protective shield and dental grade connection materials. This course can be taken in person or online and costs $1750.
Do I need any special certifications or licenses before I can take the course?
No, certification is not required to become a dental gemstone technician, nor are there any state or federal requirements, but you must check and confirm the laws in your city, state or country to ensure you are following all rules and Regulations for conducting this and any other type of business. We offer a training course to obtain a certificate of completion certifying that you have been trained in using the correct techniques, tools and adhesives to successfully and safely apply tooth jewelry. By the end of our course, you will indeed be a Certified Tooth Couture® Dental Gem Technician, as you will be “officially recognized as possessing specific qualifications or meeting specific standards” as required to work with Tooth Couture® products and services.
After paying my deposit, is there a balance remaining until the expiration date or expiry date of my deposit?
no There is no balance due or expiry date on your deposit, but please note that all deposits are non-refundable.
Do you offer a payment plan?
Yes. A customized payment plan tailored to your specific financial situation is available. Please call to set up the plan before signing up. All payments made are non-refundable. Or you can use our Learn Now, Pay Later options via Sezzle or PayPal Pay Later and start your course right away!
Can I start the course before I complete my payment plan?
No, not if you have an individual plan. The balance of the course registration must be paid in full before we can start the training. However, if you pay through Sezzle or PayPal Pay Later, you can start your course before your course balance is paid in full.
If I have paid for the course in full, do I have to complete the course by a certain date?
no Once you have paid your balance in full, you can take the course at any time. There is no expiration date on your payment and no requirement to complete the course. We will hold your payment until you are ready to attend the course. Just keep your receipt. Please note that all deposits are non-refundable.
How far in advance should I plan to start training?
Two to three weeks minimum but please check our calendar on the booking page to see what dates are available. Our appointment calendar fills up quickly. After you have paid your course registration in full, we will contact you to schedule/confirm your training day.
