You must be the child under the age of 21 of an approved H visa holder. The children of an H visa holder who are over 21 years old cannot apply for an H4 visa.
Alternatively, family members may be placed in other nonimmigrant categories for which they qualify, such as the F1 category for a spouse or children coming to college, or the H1B category for a spouse whose employer has also received approval for an H1B visa application employ the spouse.
How to apply for an H4 visa
Typically, when applying for an H4 visa, you need to complete the following steps:
Apply online using Form DS-160. When you start your H4 online visa application, you will need to print the barcode confirmation page to take with you to the interview.
Pay the applicable H4 visa fee. You should keep your receipt as you will need it later. Currently, the H4 visa application fee is $190.
Make an appointment for a visa interview with your local US embassy or consulate. After you have arranged your interview, you will receive a confirmation letter, which you must also keep.
Submit your H4 visa documentation. In addition to Form DS-160, you must provide other documents when applying for an H4 visa, including a marriage certificate or birth certificate, a copy of your spouse/parent’s H-type visa along with Form I-129, Form I-797, and the employment certificate application.
Join the Visa interview. During the interview, you will be asked detailed questions specifically to determine whether your relationship with the H visa holder is genuine or not.
Wait for a decision. The interviewing officer may be able to immediately determine if you qualify for an H4 visa. However, additional documents may be required.
Wait for your visa. If your H4 visa application is successful, you still need to wait for your visa to be processed and returned to you. You can check your visa status on the website of the US embassy where you are applying by entering your application number. Visa processing times may vary depending on the country you are applying from.
Book your ticket to the USA. You should not make travel plans until you have received your H4 visa. Please also note that the issuance of a visa does not guarantee entry into the United States. If you are applying for an H4 visa, you must submit your spouse or parent’s I-797 form. This is a Notice of Action issued as a result of an application or petition filed with USCIS for an H1B or other H visa.
The I-797 form contains the dates from and until which your spouse’s or parent’s visa is valid. An H4 visa holder is admitted to the United States for the duration of the primary H visa’s validity.
So if your spouse or parent has a visa that is valid for 3 years, your H4 visa is also valid for 3 years. However, they may stay longer using Form I-539 if the primary H visa holder is applying for an extension to stay in the United States.
What does the H4 visa allow?
H-4 visa holders are permitted to stay in the United States as long as their spouse holds a valid H1-B visa. During their stay, H-4 visa holders can attend school, apply for a driver’s license, open a US bank account, and apply for a work permit. To apply for a work permit, H-4 visa holders may submit Form I-765, Application for Permission to Work, provided their spouse on an H-1B visa:
