I have to confess, the petty, immature part of me wishes that just once, here in DFW, I saw a THD patrol car on the side of the road run over a vehicle with Nuevo Laredo plates and impress a “Mexican” Tax – only once.

I think the point wasn’t what happens if you keep it here past the 90 day temporary registration, but that if you own property in the US you can’t bring it here AT ALL. And I suspect it would be difficult to enforce if Customs didn’t have the tens of thousands of assessment districts connected to their computers. Not to mention that it would likely violate the 14th Amendment of the US Constitution.

I’m wondering what you non-Mexican citizens do for liability insurance when driving your Mexican car in the US.

I just got back from one of my fairly regular trips to Tucson, AZ, driving there in my partner’s Mexican plated car. He will race in Mexico but not in the US. So I have to do all the rides in the US.

We always stop on the Mexican side of the border en route and take out temporary liability insurance. I still don’t understand whether the liability insurance is for the driver or for the car. The agent always writes down my partner’s details and the car’s details and then we ask if we can add my name and US driver’s license details so that I can drive the car in the US as well. They always said, sure, no problem.

The penultimate time we bought the insurance in a different place than usual. Everything went as described above, except that there was a warning on the front of the policy in bold type and in red that the insurance was only valid for Mexican residents. It explained very clearly in English that any non-Mexican driver who had a claim would void the policy. We asked about it and explained that I have an FM-2 visa but have a different official residency in the US. I don’t have a Mexican driver’s license. The agent then said that the insurance was no good without a Mexican DL. I’m guessing they think Kansas is a Mexican state when they put that information on the policy.

When we got to Tucson, I called my US insurance company, 21st Century, and asked if the liability insurance I have for my US-licensed vehicle would cover me/the Mexican-licensed car while I drove it in Arizona, and they told me in no uncertain terms that I/the mexican plated car would NOT be covered. I’ve been trying to figure out if that’s because the car is plated overseas or what but got stuck on the subject.

So I’m wondering what all of you (those who aren’t Mexican citizens) do for liability insurance when driving in the US. It strikes me that all the insurance we took out was a complete waste of money because I’m the only one driving within the US and apparently the insurance was void the entire time.

If you have a Mexican car, just before most border crossings, there are companies that will sell you basic liability insurance for up to a year – the maximum time you can keep your Mexican car in the US. It’s not very expensive.

Yes, Rolly, I agree. It’s way too vague.

And now I have to admit to you, Bournemouth and others, that I had asked this question here before and completely forgot that someone (I think it was Bournemouth then too) referred me to the same website and company, SeguroGringo.com . And I had the same problems/doubts/questions about the “residents” thing back then.

I also remember calling the insurance company’s underwriters, National Unity, in San Antonio, TX and finally got put through to a lady there who told me that at the very least you have to prove you have a permanent resident of Mexico have a valid Mexican driver’s license and are not a resident of any kind anywhere in the United States. In fact, the problem is that the insured’s ONLY place of residence must be in Mexico.

And I remember the definition of domicile came up, which is what “residence” means to you, the insurer. We went back and forth and finally I told the lady that I am renting a room from my daughter in Kansas and am using that address for the purpose of maintaining legal US domicile so I can have a US driver’s license so I can get it can register and insure my US registered vehicle and qualify for a Medicare Advantage plan. I also have a mailing address at a UPS store in Tucson. She said all of that, especially the Kansas address, would be enough to disqualify me. In your opinion, I cannot be a permanent resident of Mexico if I have residency in Kansas, USA. Despite the fact that I own a home in Mexico, which is at least 99% of my home so far. I occasionally stay in hotels in the US and Mexico and when visiting my daughter in Kansas I stay at this address where I am a legal US resident.

So at least in my case, I’m convinced that because I reside in Kansas and because I don’t have a Mexican driver’s license, that insurance wouldn’t apply to me. They would not consider me a permanent resident of Mexico. I think if I eventually got Mexican citizenship, this residency issue might still haunt me.

There is a chance that some US liability insurance (for my pickup truck with US registration) will cover me if I am driving my partner’s car in the US. I have yet to investigate this possibility, but I’m not very hopeful. Once they hear that the vehicle I’m talking about has Mexican license plates and is owned and registered by a Mexican in Mexico, I doubt they’ll back me up. We will see.

For me, that now means I can’t drive my partner’s car while we’re shopping in Tucson. We’d rather take it instead of my pickup because it’s much newer and in better condition. It’s cheaper to operate and actually holds more stuff securely in the trunk or in the back seat while stuff in the bed of my pickup truck isn’t safe.

My partner wisely says there are sacrifices we all have to make in life and this is another of many for me as I try to drive round pegs into square holes by trying to put a foot in Mexico and the US to live others in the US.

It doesn’t matter what they tell you, the only thing that matters is what’s in the actual contract. If the contracts state that you are a resident of Mexico and you have proof of residency in Mexico, residencies you hold elsewhere do not change that. Many people have multiple residences in multiple countries. Your interpretation would never stand up in court or before an insurance department.

The Mexican system for obtaining a driver’s license has long been unique. The fact is that until 2014 the driver’s license was issued to anyone over the age of 18, who could pay $ 50 and present a document confirming identity and place of residence. In the local bank you pay the cost of acquiring a driver’s license. A receipt of payment, originals and copies of the above documents must be submitted together with the application for a license to a specific local office (Modulo): either “Centro” or “Siglo XXI”.

It is also necessary to pass an eye test at the doctor and tell about the blood group (in case of lack of information about the latter, it is necessary to do a blood test).

Now you need to find (or buy a paper copy) an electronic version of the Local Laws and Driving Rules booklet on the internet. The booklet is published in Spanish, but you can pass a written theory test in English as well as in it. Apply to the local office (modulo) as you did when the license was first granted. Contact one of the USE offices (Unidad de Servicios Electronicos) – at the earliest 60 days before the license expires and at the latest 30 days after. Renew the license online – no earlier than 12 months before the license expires and no later than 30 days after. In this case you will need a credit or debit card to pay the fee. The new license will be delivered by DHL express service or you can pick it up yourself at the Secretaria de Seguridad Publica.
