Baby’s death during rape ‘as heinous as it gets,’ West Michigan prosecutor says

GRAND RAPIDS, MI – A prosecutor said the trial for a man accused of killing his infant daughter during an oral rape took a toll on everyone – family, investigators, attorneys and the jurors who were subjected to disturbing testimony and photos before convicting Steven Deuman Jr. of first-degree murder.

“This was a very difficult case for anyone to have to hear,” Assistant U.S. Attorney Phil Green said Wednesday.

“This is about as heinous as it gets. That’s a tragic reality here. He did do it. A beautiful 15-week-old baby girl lost her life, lost her future, because of his need for sexual gratification.”

Deuman, of Suttons Bay near Traverse City, was convicted of first-degree murder and aggravated sexual assault of his 15-week-old daughter, Evelynne Deuman.

He shook his head back and forth as U.S. District Judge Gordon Quist read the verdict. Jurors deliberated about an hour. A sentencing date was not set, but Deuman faces a mandatory sentence of life in prison.

He maintained that he put his daughter on his bed while he stepped outside for a cigarette. He returned to find her not breathing on the floor and with a discarded condom in her mouth, the defense said.

Green said that Natasha Maitland, the baby’s mother who also has a son with Deuman, too, proved extremely important in the investigation. She testified on behalf of the prosecution.

“I could not be more impressed with Natasha Maitland’s courage through this whole process,” Green said. “She is a remarkable young woman. It’s my fervent hope she can put her life back together. She was forced to endure (a loss) no one should ever have to endure.”

When the judge read the verdict, Maitland wept and hugged those near her.

Later, someone whispered, “Justice was served.”

They declined to comment as they left the courthouse.

Maitland was at work on Aug. 12, 2010, when her daughter died.

Green told jurors that Deuman killed the girl during the oral rape, and then he considered scenarios throughout the evening to suggest she died of an accidental cause. He didn’t call 911, but told Maitland on the telephone that their daughter wasn’t breathing.

By the time he talked to Maitland, the girl had likely been dead for some time, Green told jurors.

“He’s got to come up with a potential explanation for what they might find in her mouth,” he said. “The ultimate question is, how did that condom get in her mouth?”

Green said Deuman’s version of events didn’t make sense.

“This was no accident. She couldn’t roll over, much less crawl. She certainly wasn’t capable of overcoming the obstacles on her bed, the pillows, to end up on the floor. Even if (she did), how is she going to suck that condom up?”

Finally, Green told jurors: “It’s hard to imagine anything more objectionable than the oral rape of a 15-week-old baby.”

Jurors also heard from witnesses who, as children, claimed they also were sexually abused by Deuman.

Defense attorney Richard Stroba said his client was a “proud father” who wouldn’t harm his own children. He insisted the death was an accident.

He said that tragedy wasn’t necessarily a surprise given that 10 people, along with a dog and cat, shared a double-wide mobile home in Leelanau County.

“The reality is, that room, that house, was an accident waiting to happen,” Stroba said.

He said prosecutors unfairly portrayed his client as an “unbridled sex fiend.”

The case was handled in federal court because the killing occurred on an American Indian reservation in Northern Michigan, land held in trust by the federal government for the Grand Traverse Band of Ottawa and Chippewa Indians.

The body of a baby was found floating on the Catawba River between Rock Hill and Fort Mill on Aug. 12, 1992. She was only hours old when she died. The baby was found wrapped in a bedsheet, inside of a plastic shopping bag, floating in the Catawba River by a swimmer near the Highway 21 Bridge.

She had stab wounds, but the coroner’s report determined that death was the result of suffocation, and not drowning or the stabbings.

Detectives reexamined the case in October 2020 and were able to submit DNA from the bed sheet that held the baby to the York County Forensic Biology Lab for testing. Results from this DNA testing identified Rabon as a suspect and deputies were eventually able to obtain a warrant for her arrest for homicide by child abuse.

“I am very thankful for the hard work of our detectives and DNA analysts. Their dedication and ability to work cooperatively has led to the closure of a case that has haunted our community for years,” said York County Sheriff Kevin Tolson. “While nothing can right this terrible wrong, there is some comfort in knowing that justice will be served thanks to the men and women who worked on this case.”

In 1992 the baby was named Angel Hope, rather than Baby Jane Doe, by members of the community who also paid for her burial expenses. Angel Hope is buried at the Forest Hills Cemetery, Section 4, in Rock Hill, S.C.

Rabon is being held at the York County Detention Center.

West Virginia man sentenced to life without parole for fatal infant sex assault

UPDATE (April 4):

A West Virginia man has been sentenced to life in prison without the chance for parole for sexually abusing and killing his girlfriend’s 10-month-old baby.

A Jackson County Circuit Court judge sentenced 33-year-old Benjamin Taylor of Cottageville to life for first-degree murder, 40 years for death of a child by child abuse, and at least 10 years for sexual abuse by a guardian or custodian. The first two sentences are to run consecutively.

A sheriff’s deputy testified Taylor had blood on his torso and a wet spot on his pants when officers went to the home in Fairplain in October 2016.

Taylor testified he consumed several beers while the girl was under his care but could not recall what happened to her the night of her death.

After only about two hours of deliberations, jurors found Taylor guilty.

“A piece of all of us died that day that Emmaleigh passed away,” Ross Mellinger, Chief Deputy of the Jackson County Sheriff’s Department said on the day of Taylor’s conviction.

He saw little Emmaleigh Barringer hours after she was brutally sexually assaulted.

“I don’t know how you even prepare for a case like this,” Mellinger said.

“Instead of trying to get her help, he tried to wash away the blood even while she lay gasping for air and grasping to life,” Jackson County Prosecutor Katie Franklin said.

In her closing statement, Franklin told the jury that Taylor deserved no mercy.

“That’s how much mercy he had for Emmaleigh Barringer, that’s how much care he had for the life he took, show him that level of care, show him that level of mercy, in other words, show him none,” she said.

UPDATE (March 19):

On Tuesday afternoon, a West Virginia jury found Benjamin Taylor guilty of the murder and rape of a 10-month-old girl.

After only about two hours of deliberations, jurors found Taylor guilty of first-degree murder, guilty of death by child abuse, and guilty of sexual abuse by a guardian. In total, he faced five charges, but two were superseded by the others, so he was essentially found guilty on all charges.

The seven-woman, nine-man jury recommended no mercy. Taylor rocked back and forth with his hand over one side of his face during the verdict. Some family members sobbed softly after that verdict.

He has been on trial since last week for killing 10-month-old Emmaleigh Barringer, as well as sexually assaulting her.

On Monday, Taylor took the stand in his own defense. He said he blacked out the night of the alleged crime, so he could not say for certain whether he raped and murdered Emmaleigh.

A West Virginia man accused of sexually assaulting and killing his girlfriend’s 10-month-old baby says he consumed several beers and could not recall what happened to the girl the night of her death.

Benjamin Taylor testified Monday in his ongoing trial in Jackson County Circuit Court.

Asked by a prosecutor whether he denied committing the crimes, Taylor said, “I don’t know how I could deny it if I don’t remember. I wouldn’t feel comfortable denying it.”

Taylor says he recalled doing laundry and listening to music.

A sheriff’s deputy testified last week Taylor had blood on his torso and a wet spot on his pants when officers went to the home in Fairplain in October 2016.

The infant, 10-month-old Emmaleigh Barringer, was found unresponsive in a pile of blankets nearby, covered in blood.

The defense rested after Taylor’s testimony and the trial is scheduled to resume Tuesday.

UPDATE (March 15):

The third day of Benjamin Taylor’s murder trial is set to begin.

He is charged with murder, sexual assault, and child abuse in the death of 10-month-old Emmaleigh Barringer.

In October 2016, investigators say Emmaleigh Barringer’s mom found her unresponsive and covered in blood when she was in Benjamin Taylor’s care.

Emmaleigh died a few days later. Taylor was dating the mother, Amanda Adkins, at the time.

In court Thursday, the second day of testimony, was more about the investigation.

Day one of the trial, on Wednesday, consisted of narrowing in on members of the jury, opening statements, and a very emotional testimony from the victim’s mother.

Several officers from different law enforcement agencies took the witness stand to testify. A lot of the questions that were asked were technical: who got to the scene at what time, what they saw, etc.

Most of the officers had consistent memories of that day and the crime scene. They mentioned how hysterical Adkins was on scene, and how Taylor kept lifting up his shirt to show the officers he had dried blood on his chest and torso, but didn’t know where it came from.

Body camera footage and audio recordings of Taylor were shown as evidence in court Thursday. Pictures of the crime scene were also displayed, and a member of the Kanawha County Sheriff’s Office, who evaluated the crime scene, testified. He said processing the scene took several hours.

The defense attorney for Taylor, Tim Rosinsky, has been consistent in saying his client has been falsely accused. He said the investigation should not have just been focused on Taylor, saying investigators should have interviewed neighbors.

Chief Deputy Ross Mellinger with the Jackson County Sheriff’s Office responded, “This particular crime scene didn’t involve what you called the neighborhood. Matter of fact, it is was even more restrictive than the residence itself. It was more restricted than just one level of the residence; it was restricted to one room and particularly one area of that room.”

The pictures of the crime scene in court showed the blood and other evidence was just in one corner of the basement.

Mellinger was also called to come to the scene around 5 a.m.the day of the crime. On the stand, he recalled what that moment was like.

“He says, ‘sorry to wake you, but I think I have a dead baby.’ And you know how things are when you wake up in the middle of the night, you kind of rub your eyes. I asked him to repeat what he just said. He said, ‘I think I have a dead baby, I need you to come out.’ He said he was on scene here and there was an infant child and he believed it had been sexually assaulted. I just kind of sat there for a second trying to process what he was telling me.”

Mellinger said still to come is DNA evidence and jail phone call records from Taylor.

UPDATE (12:04 a.m. March 14, 2019):

Emotional, gut-wrenching and extremely disturbing testimony that was tough for anyone to hear began Wednesday in the rape and murder case of 10-month-old Emmaleigh Barringer.

“She was a ten-month-old child who loved and trusted in the way that only babies can. She didn’t deserve to be sexually assaulted, she didn’t deserve to be murdered. She was innocent,” said Jackson County Prosecutor Katie Franklin.

The defendant, Benjamin Taylor, was the boyfriend of Emmaleigh’s mother at the time and is accused of raping and killing the girl on October 2, 2016.

In opening statements, the Jackson County Prosecutor told the jury they would hear a lot of gruesome details about how the baby died.

“You’re not going to hear a whole lot about the 10 months she was alive,” she said.

Emmaleigh’s mother, Amanda Adkins, woke up that morning and began looking for Taylor. She found him with no shirt on and unbuttoned jeans and Emmaleigh was lying in a pile of blankets on the floor.

“I asked him what he was doing, he said he was drying her off. I asked him why he was drying her off at 5 o’clock in the morning,” Adkins said.

She noticed there was something wrong with the girl’s face and asked him what happened and he told her he didn’t know.

Adkins said she hit Taylor in the face and then picked up her child and went upstairs to call 911.

“She could tell Emmaleigh was covered in blood. She was gasping for breath and she was ice cold,” said Franklin.

The defendant’s lawyer agreed that what happened to the baby is horrible, but said that Taylor is innocent.

He was initially charged with first-degree sexual assault before the infant died. He told deputies after his arrest that he took the baby to the basement of an apartment while doing laundry, but “blacked out” and didn’t know how the injuries occurred.

“It’s also tough to think that you’re being accused of it when you didn’t do it,” Taylor’s lawyer said.

During her testimony, the girl’s mother reflected on her daughter’s strength in her short life.

“She was born 8 weeks early, but she was a fighter,” Adkins said.

During the course of this trial, the West Virginia Senate passed a bill known as “Emmaleigh’s law” to increase the sentence for those convicted of child abuse cases causing death from a current sentence of 10-40 years in jail to a sentence of 15 years to life.

In the immediate aftermath of Emmaleigh’s death, a petition to Congress was created online to call for the public hanging of Taylor. It was online for a few weeks, before the White House acted to remove the petition due to the action being called for being inherently illegal in the U.S. judicial system.

The trial of a man from Jackson County, West Virginia, accused of sexually assaulting and murdering a 10-month-old baby girl is underway.

The West Virginia hearing of a man accused of fatally sexually assaulting the 10-month-old daughter of his then-girlfriend in 2016 has been closed to the media and public.

Jackson Circuit Judge Craig Tatterson approved a joint motion from prosecutors and defense attorneys to close 33-year-old Benjamin Ryan Taylor’s hearing Thursday. Taylor is charged with murder, sexual assault and child abuse in the October 2016 death of 10-month-old Emmaleigh Elizabeth Barringer.

County prosecutor Katie Franklin moved to close it, citing a 1980 state Supreme Court case that says a judge must consider if the defendant’s right to a fair trial will be damaged if court proceedings remain open. It also says a judge must consider if pre-trial hearing discussions will increase adverse publicity.

During the three-hour hearing, the attorneys argued over evidence of lab results.

Taylor told deputies after his arrest that he took the baby to the basement of an apartment while doing laundry, but “blacked out” and didn’t know how the injuries occurred.

Taylor reportedly had a criminal record but nothing of this magnitude, said county Sheriff Tony Boggs, who suggested no explanation for motive.

“I don’t know of any normal human that could fathom what would possess somebody to do that,” Boggs said.

He was initially charged with first-degree sexual assault before the infant died. A criminal complaint shows the baby had extensive bleeding. The complaint says the injuries indicated a violent sexual assault, as well as shaking or striking of the face.

A woman who killed two of her newborns and encased their bodies in concrete was sentenced Tuesday to 30 years to life in prison.

Stacy DeBeer, 30, pleaded guilty to second-degree murder two weeks ago in exchange for two consecutive sentences of 15 years to life in prison — meaning she will serve 30 years before she can seek parole.

“My babies deserved more,” DeBeer, weeping and shaking, said at her sentencing. “I will live with this everyday.”

Before dawn on May 11, 2003 — Mother’s Day and her 29th birthday — DeBeer said she gave birth on her living-room couch, placed the infant girl in a garbage bag and hid the body. She told police she killed another newborn, also a girl, five years earlier.

DeBeer told relatives she was pregnant last year. When a baby failed to materialize, a relative snooping around the basement of DeBeer’s home in Farmington found the dead newborn encased in concrete in a plastic pail.

The other child’s body was found in a bucket of concrete left in a garden shed at DeBeer’s former home in Canadice, another rural town in western New York.

DeBeer’s 32-year-old husband, Brian, was charged with hindering prosecution by helping hide the first infant in June 1998. His trial could be held next month.

The couple have an 8-year-old son and a 7-year-old daughter who are being cared for by relatives.

Recent toddler death brings back memories of Ethan Stacy

FARMINGTON — Five years ago this week, Davis County Attorney’s Office and Layton police were reviewing evidence in a child abuse murder case that shocked the community.

This week both agencies are reviewing evidence in another possible child abuse homicide case against Joshua Schoenenberger, 34, and Jasmine Bridgeman, 23, of Layton. The pair are accused of causing the death of 2-year-old James Sieger, Jr., son of Bridgeman. Schoenenberger was her boyfriend, officials said.

The boy’s father, James Sieger, traveled from Georgia to Utah after police called him. The toddler, also known as JJ, was flown to Primary Children’s Medical Center from Davis Hospital in Layton where Bridgeman and Schoenenberger took him on May 9.

JJ, who was in critical condition, underwent several emergency surgeries. He died early Monday morning after he was taken off of life-support.

The couple told emergency medical staff at the Layton hospital that JJ had drowned in the bathtub at their home at 224 E. 1450 North, Layton, officials said. The boy’s injuries did not match up with their stories and police were called. They were arrested and booked in the Davis County Jail on child abuse charges.

Now they both could be charged with murder and it could take up to a week before formal charges are filed in 2nd District Court, to give investigators time to review all of the evidence, officials said. Both Schoenenberger and Bridgeman are being held without bail.

Police said JJ was having difficulty breathing when he arrived at the Layton emergency room and had injuries consistent with on-going physical abuse.

According to the probable cause statement of arrests filed with the Davis County Jail, Bridgeman admitted to police that Schoenenberger got upset with the toddler “over potty training issues, specifically that (James) had pooped in his diaper.”

JJ was severely beaten and had been stomped on, according to the probable cause statement. Schoenenberger had admitted to police he had stepped on the boy after dropping him onto the floor.

Schoenenberger was in 2nd District Court on Wednesday for a felony arraignment hearing for drug charges. He entered not guilty pleas and a pretrial conference is scheduled for June 10 before Judge David Hamilton in that case.

His attorney, Todd Utzinger, told Hamilton that Schoenenberger is being held at the jail on pending charges. Schoenenberger at that time waived his right for prosecutors to make a decision on what charges they will file until May 22.

“The Davis County Attorney’s Office and Layton Police are reviewing the evidence in order to make a charging decision in the coming days,” said Chief Deputy Davis County Attorney David Cole.

Cole could not comment on whether or not his office is considering filing aggravated murder charges under Shelby’s Law against Bridgeman and Schoenenberger.

Five years ago, Layton police arrested Nathan and Stephanie Sloop, who were both charged with aggravated murder under Shelby’s Law. They were the first defendants in Davis County to be charged under that law since it went into effect in 2007.

The Sloops were convicted separately of aggravated murder of 4-year-old Ethan Stacy in Layton who died on May 8, 2010. Ethan’s disfigured and burned body was found in a shallow grave near Powder Mountain on May 11, 2010, after the Sloops called police to report him missing from their apartment. Ethan came to Utah from Virginia on May 1, 2010, to spend the summer with his mother, Stephanie Sloop. The Sloops were arrested on May 11, 2010, and charges were filed in 2nd District Court on May 28, 2010.

Stephanie Sloop was sentenced in November of 2014 to 20 years to life in prison.

Nathan Sloop pleaded guilty but mentally ill in February of 2014 and received 25 years to life.

Ethan’s father and step-mother, Joe and Becky Stacy traveled from Virginia to attend the hearings when the Sloops entered guilty pleas and were sentenced.

And this week the Board of Pardons & Parole announced neither Sloop will receive their first parole hearing for 40 years.

Shelby’s Law was named after 10-year-old Shelby Andrews of Syracuse was found dead in her home in August of 2006. Her father and step-mother admitted to beating her, forcing her to eat her own feces and locking her in a linen closet as a form of punishment.

Ryan and Angela Andrews entered guilty pleas to first-degree felony murder charges and were each sentenced to serve 15 years to life in the Utah State Prison.

Prosecutors could not file capital murder charges against the couple because they could not prove the two had intentionally killed the young girl.

The law now allows officials to file aggravated murder charges when a child dies due to injuries suffered from serious child abuse or more than one incident of abuse. If a person is convicted of aggravated murder under Shelby’s Law, they can be sentenced to death, life without parole or a life sentence with the possibility of parole.

Since this IS a very slow news Sunday, and yet I am in a posting mood, I am

going right ahead and posting some news items that are a FEW days old, but IMO,

still very interesting and worthy of being posted, since I was too busy during

the week to post them, and you guys for the most part were too busy trolling &

making off-topic posts of all sorts, while important True Crime news passed you

by.

Over in Tennessee, we have a 21 year old Mommy named Stacey Upton who is

facing second degree murder charges for having slaughtered her newborn slave

about 3-5 months ago. Mommy Stacey is charged with smothering the newborn, who

was born alive and full-term, to death. She admits to the killing, and tells

cops: “I killed it because I did not want it”. FINE answer, beautifully in tune

with your diseased society’s TEACHING and PREACHING that all children are

nothing more than owned, subhuman, pieces of property, belonging to their

creators, for their creators to do with as they please.

We learn below that after killing her slave, Mommy Stacey simply SHOVED the

dead body underneath her bed and let it ROT there for MONTHS, sleeping in the

same room, on the bed, directly above the rotting slave. Her BROTHER called

police after FINDING human bones and an insect infestation underneath Mommy

Stacey’s bed, while he was repairing an air conditioner in her room.

Mommy Stacey did live at home, with her slaveowners, and her Daddy admits

that he noticed a “foul odor” coming from her room, and that she used

tremendous amounts of air fresher to try and block out the stench of the

decomposing slave, as well as burned incense in her room. But he says he just

minded his own business and never did try to determine the exact cause of the

persistent foul odor.

There ya have it folks, an OVERLOOKED slave murder incident that none of you

would have known about were it not for my dedicated love of true crime and

devotion to finding and reading and SOMETIMES posting to this NG, items like

this one that catch my fancy.

(KNOXVILLE) — A Knoxville mother is accused of smothering her newborn child.

Twenty-one-year-old Stacey Upton surrendered to authorities yesterday. She is

charged with second-degree murder. Upton told police she had the child by

herself then killed it because she did not want it. Her brother discovered the

baby’s remains this summer. He said he noticed gnats and bones underneath her

bed while he repaired a window air conditioner. An autopsy revealed the bones

were the remains of a full term baby.

Staceye Upton’s father often had wondered about the foul odor emanating from

his 20-year-old daughter’s bedroom.

The woman frequently sprayed air freshener and burned incense to mask the

stench, but it wasn’t until someone looked under the bed in her Brooks Road

home that the mystery was unveiled.

Covered with blankets and clothing were the skeletal remains of a full-term

baby.

The gruesome July 13 discovery resulted in the surrender Tuesday of Upton to

authorities on a charge of second-degree murder.

The woman, now 21, was jailed in lieu of $50,000 bond.

She had been indicted last month by a Knox County grand jury on the charge.

Knoxville Police Department Investigator Sam Brown said the discovery was made

by Upton’s brother, who was trying to fix a window-mounted air conditioner.

“He noticed a bunch of gnats and flies,” Brown said.

“He had to move the bed to get to the air conditioner and he noticed a bunch of

bones.”

Upton’s brother alerted his father about his discovery of the bones.

Upton’s father then called police and told them about the persistent odor that

he had detected from the upstairs bedroom.

Dr. William Bass, a forensic anthropologist, examined the remains that included

a tuft of hair and determined that the they were from a full-term baby.

Bass was unable to determine the sex of the infant.

Brown said Bass estimated that the baby’s body had been under the bed for two

to four months.

Authorities were unable to determine the cause of death from the remains.

Subsequent interviews with Upton led Brown to say the baby had been smothered.

“She said she covered it up with blankets and clothes because she didn’t want

to hear it crying,” Brown said.

“She had it on her own and no one else knew and she didn’t want the baby.”
