And to prevent this, a trademark owner may be able to prevent others from using their trademark (or a similar trademark) without permission when that use may cause confusion.

Let’s get to work now.

1. Check the status of the account you want to get the username from.

Before anything else, you need to understand what the current state of the username you want to get is. This step is a must to plan how you will describe the content of the report. You don’t want to miss anything.

How many posts does the account have?

When was the account posted for the first and last time?

Is the account’s business category the same as yours?

Is the user’s content similar to yours?

Does it have a defined logo on its profile picture?

Can user content confuse your audience?

Can this account jeopardize your brand?

Keep in mind that if the account isn’t active or private, things get more complicated for you.

2. Make an offer…?

Let’s be fair. If you don’t own the username, it’s because you were late to the party. In that case, you could do what I see fit and try contacting the user to make an offer before using the power of the law.

In my case, I contacted @Mercating’s user and made an offer of $500 (although I wasn’t successful).

Of course, making an offer is entirely up to you, and it’s totally fine if you don’t want to make one.

3. Navigate the Instagram Help Center.

Reporting these types of issues on Instagram is difficult. For convenience, you may want to start this process from any display device other than a mobile device. The images you see below are for demonstration purposes only.

To visit the Instagram Help Center, go to https://help.instagram.com/

From the sidebar menu, click Privacy & Security Center > Report Something > Intellectual Property > Learn more about reporting trademark infringement.

Once you click Learn more about reporting trademark infringement, you’ll be taken to the Trademark page. From there, click on “Fill out this form”.

You should now be on the Report a Violation or Violation of Your Rights on Instagram page.

Next, select “Brand” and “Continue with your brand report.”

4. Fill out the trademark notification form

5. Write a clear statement to get a given Instagram username

had no posts yet. (And has been for at least 3 years.)

was opened after I registered my trademark.

In order to write a clear and concise statement, you need to check the status of the account you are trying to report (Step 1). If you haven’t already, it might be a good idea to go back and understand what you’re about to report.

This is how I did it in my case:

First, I provided some background information.
