At least not legally.

That’s because his bread contains too much sugar, the court said Tuesday. The country’s Value Added Tax Act of 1972 states that tax-exempt bread may contain no more than 2% of the weight of flour, sugar, fat and bread improvers.

In Subway’s recipe, sugar makes up 10% of the weight of the flour, according to the judgement. That’s five times what the law deems acceptable.

The law distinguishes “bread as a staple food” from other baked goods that are “or come close to being confectionery or pastry.” In other words, the court found that Subway’s bread may legally be closer to cake than bread.

“The resulting product does not fall within the definition of ‘bread’ for the purposes of the law,” the decision reads. Five judges reviewed the case.

An Irish Subway franchisee, Bookfinders Ltd., prompted this legal interpretation after applying for a tax break on some of its menu items.

The country allows 0% sales tax on “staple foods,” which include bread. The franchisee originally filed a claim in 2006, seeking a refund of a portion of the sales tax paid in 2004 and 2005.
