The use of fake IDs by students seems to be increasing every year.

Many teenagers have obtained fake IDs or driver’s licenses, or have used someone else’s driver’s license or ID, to purchase alcohol or enter entertainment venues where they are not normally allowed entry. The fake IDs, of course, show they are older than they actually are, usually 21 or older for alcohol-related activities and 18 or older to get into some nightclubs.

A few parents have pointed out to me that some children don’t see the possession and use of fake IDs as a big deal. These parents want to know what the possible legal ramifications of fake IDs are.

Under Kentucky law, it is illegal to knowingly provide false information when obtaining a driver’s license or identification card. Possession and/or use of a fictitious driver’s license or ID card, or possession or use of a driver’s license that has been revoked, confiscated, suspended or owned by another person is also illegal. It is also illegal to hold more than one operator license.

Contrary to what most minors think, violations of the above laws regarding fake ID carry very severe penalties ranging from a Class B misdemeanor to a Class D felony. Someone who possesses or uses a counterfeit ID can be charged with criminal possession of a counterfeit instrument, which is a Class D felony punishable by up to five years in prison and a fine of up to $10,000. They could also be charged under the Kentucky Traffic Act with illegal use of driver’s licenses, which is a Class B misdemeanor punishable by up to 90 days in prison and a fine of up to $250.

Obviously, as mentioned above, very serious consequences are possible for minors who use fake IDs. I strongly encourage all parents to make their children aware of these serious consequences. In the past, children and their parents have invariably been shocked when charged in court with a felony and/or misdemeanor because the children used or merely possessed fake IDs or driver’s licenses.

“Electronic Bouncer”: Bars and clubs use ID scanning systems to gather information and keep troublemakers out

MILWAUKEE (CBS 58) – About five bars and clubs in the Milwaukee area use an ID scanning technology called “PatronScan.”

According to the company, only your name, date of birth, photo, gender and zip code are captured when you scan your ID.

“This technology serves one primary purpose, which is to keep customers and employees safe in a small business,” said Marko Mlikotin, spokesman for PatronScan.

Its primary purpose is to identify fake IDs, underage drinkers, and guests who have a history of violence and sexual assault.

If someone is causing trouble or some kind of “disturbance,” the owner can tag that person.

“The subject has advantages and disadvantages. It’s good that people like that don’t exist anymore,” said Reilly Bauer, who lives in Milwaukee.

However, some people say that this technology would prevent them from entering a facility.

“Why would you want to give all that information to a bar, do you really trust them?” asked Bob Hunt while visiting Milwaukee.

In Sacramento, a city ordinance requires all bars and clubs to use an ID scanning system. In Wisconsin, it’s up to the individual club or bar to decide whether to scan their customers.

The Tavern League of Wisconsin says it’s a useful tool, but not for everyone.

“Obviously we are against underage drinking, but we don’t think giving every company a blanket mandate is a solution,” said Pete Madland, executive director of the Tavern League of Wisconsin.

In a 2013 law, Wisconsin banned any municipality from providing ID scanners of any kind.

The company says the data will not be shared or sold to anyone. If the ID is not marked, the data will be permanently deleted after 90 days. According to PatronScan, this gives crime victims time to report a crime so law enforcement can go through the records to identify a suspect.

“It is public safety and under no circumstances should this information be shared or sold,” Mlikotin said.

PatronScan did not specify which Milwaukee facilities use the technology.

When fake IDs can get you in trouble

Manufacturing or selling counterfeit California ID cards

There are several ways that fake IDs can get you charged with a felony in California. Regardless of the charge, in order to be convicted of a fake ID-related crime, you must have intent to be fraudulent. Whether you have been involved in the manufacture, sale, and distribution of fake IDs, or simply possessed a fake driver’s license, you can be prosecuted. The type of offense you committed will determine the amount of your sentence.

The California Department of Motor Vehicles is the only authorized issuer of government IDs and driver’s licenses. This means that it is a criminal offense for everyone else to produce or distribute ID cards.

Identity cards are not simply driver’s licenses. The California DMV issues an official ID to anyone of any age, for identification purposes only. Driving licenses are a separate subset of ID cards issued by the DMV.

If you’re caught with someone else’s ID in Illinois, you could be charged with a Class A misdemeanor, punishable by up to a year in prison and a fine of up to $2,500.

Don’t freak out yet

Of course, getting caught with a fake ID is very serious. But if this has happened to you, there are a few things you should consider before you convince yourself that you will end up behind bars.

First, after being charged, you still have to be convicted. Then defy your state and national governments — and refuse to get “real ID.”

Real ID is such a bad idea that patriots of all stripes should boycott it. “Real ID” refers to state driver’s licenses that meet newly enforced federal guidelines. Effective October 1, 2020, you may no longer use a driver’s license to board a domestic flight — or enter federal facilities — unless that driver’s license is a genuine form of identification.

Real ID licenses have stars but otherwise look like the licenses you already have. The difference is the privacy you have to give up; To obtain one, you must provide original birth certificates, social security cards, other personal identification documents, multiple proofs of residency, and other information proving your legal status in the United States.

Such requirements may sound like they increase security, but the opposite is true. New security risks arise as people submit more identification to databases searchable by a government that already monitors our calls and digital communications. Real ID offers new opportunities for hackers and terrorists to steal our identities, and for governments and corporations to discriminate against us.

And by requiring genuine ID for travel within the country, the American government is creating an “internal passport” of the kind that oppressive regimes (like North Korea) use to restrict the movement of their people and create distinct classes of citizens.

With state governments – shamefully California’s included – now encouraging people to get real ID, the best defense is to refuse to comply. If enough Americans opt out, Real ID cannot become the standard.

Those 100 million Americans without real ID or other government-recognized IDs like passports should refuse to get them. Those of us who have compliant IDs should refuse to show them and insist on entering airports and government buildings that our tax dollars pay for. And we should all complain to elected officials until Real ID is as dead as Stalin, the kind of person who would have appreciated it.

This American horror story began on 9/11 when hijackers fraudulently bought Virginia driver’s licenses to board airplanes. After that, states cracked down on driver license fraud and tightened security measures. Since then there have been no more kidnappings. But the American security state is never satisfied. For example, the Real ID legislation passed without much debate in 2005, as it was part of a tsunami relief act.

However, many states resisted implementing Real ID, citing compliance costs and privacy concerns, and the federal government delayed enforcement. President Obama, a critic of Real ID, ignored the request.

But the Trump administration revived Real ID in 2017, claiming it was necessary to protect the country from foreigners. The Department of Homeland Security has successfully pressured states through carrots (more federal money), sticks (states fear their citizens can’t board planes), and policies of appearing weak to terrorism.

After states give in, ordinary citizens are the last line of defense against Real ID’s many dangers.

Real IDs could quickly become national IDs needed to find a job, rent an apartment, organize childcare, pick up a prescription, board a train, make hotel reservations, pay with a credit card, or—ultimately—your exercise right to vote. Before long, those unable to obtain real ID cards will be second-class citizens.

The whole idea is discriminatory – against Americans. Under Real ID, an international criminal with a valid passport can automatically travel around our country at will. But your neighbor who can’t produce a certified birth certificate or social security card isn’t going to fly southwest to Phoenix to watch spring baseball training. If real ID were required now, 80,000 people could be barred from boarding planes every day.

Real ID will enable federal government discrimination against immigrants as those unable to secure Real ID become ICE targets. Naturalized Americans are denied real ID because of bureaucratic suspicions about their foreign birth certificates. Security experts say genuine IDs are easily hacked and, because they’re machine-readable, allow for broader tracking of individuals.

Real ID compliance ties California’s overwhelmed DMV in knots as the vast majority of our 27 million drivers do not have Real ID licenses. In 2018, California issued two million Real IDs — before the Trump administration changed standards for issuance without warning. (These real IDs remain valid, but must be renewed with the other standard).

So let’s stop conforming. California should stop issuing real ID cards and legislators should stop businesses from requiring customers to produce real ID. Defiance isn’t easy, but here’s our best strategy. Because Real ID is not compatible with life in a free society.
